TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use ("Terms") apply to all products and services offered by Sarah Rhodes trading as Plastic Free Southeast Asia (ABN: 18 159 935 027), registered at Mosman NSW 2088, Australia - herein referred to as "we," "us," or "our."

NOTICE: These Terms are legally binding. Please read them carefully before purchasing or accessing any of our Offerings.
1. GENERAL
This website and its associated sales pages are owned and operated by Sarah Rhodes trading as Plastic Free Southeast Asia. You must be at least 18 years of age to purchase or access our Offerings. These Terms are subject to update at any time, with the 'Last Updated' date revised accordingly.
2. AGREEMENT TO TERMS
By purchasing or accessing any of our Offerings - including online programs, advisory services, training sessions, workshops, or digital materials - you agree to be bound by these Terms. If you do not agree, please contact us at [email protected] before proceeding.
3. OUR SERVICES
Our Offerings include sustainability advisory services, team training, mentoring programs, online workshops, and related educational materials. Specific details of what is included in each Offering are set out on the relevant sales or checkout page.
Any changes to the scope of an Offering after purchase must be agreed in writing by both parties. Changes may result in adjusted fees and timelines, which will be communicated to you before implementation.
4. PAYMENT
4.1 Prices and Payment All prices are in Australian Dollars (AUD) and include GST unless otherwise stated. By completing checkout, you authorise us to charge your selected payment method for the total amount shown.
4.2 Invoicing Where services are delivered on a monthly basis, invoices will be issued monthly and are payable upon receipt.
4.3 Upfront Payment Some Offerings may be purchased in full upfront at a discounted rate, as specified on the relevant sales page.
4.4 Price Changes We reserve the right to update pricing for future purchases at any time. Prices will not change for purchases already completed.
4.5 Errors in Pricing We reserve the right to correct any pricing errors, including after payment has been received. You will be notified in writing of any such correction.
4.6 GST We are registered for GST in Australia (ABN: 18 159 935 027). GST is applied in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
4.7 Quotations Quotations are valid for 30 days from the date of issue unless otherwise specified. If you wish to proceed after this period, please contact us to confirm pricing and availability, as a revised quotation may be required.
5. ADDITIONAL EXPENSES
Costs not included in your service fees — such as travel, accommodation, or special requests — will be communicated in advance and billed separately. Travel and associated expenses for in-person delivery are the responsibility of the client. Any agreed additional expenses are payable within 14 days of invoice. Non-payment may result in suspension or termination of services.
6. REFUND AND CANCELLATION POLICY
6.1 General Due to the nature of our services, refunds are not available unless otherwise specified in writing at the time of purchase.
6.2 Cancellation by You If you wish to cancel your Offering, please notify us in writing at [email protected]. Cancellation does not excuse outstanding fees for services already delivered. Any out-of-pocket expenses already incurred by us (e.g., travel) remain payable regardless of the reason for cancellation.
6.3 Cancellation by Us We reserve the right to cancel or refuse to fulfil an Offering where circumstances reasonably require it. In such cases, a proportionate refund will be issued for any undelivered services.
6.4 Chargebacks Please contact us before initiating a chargeback with your financial institution. In the event of a chargeback, we reserve the right to present evidence of your access and agreement to these Terms to the relevant institution.
6.5 Pausing Services If you wish to pause your program, the pause duration, resumption date, and any applicable fees must be agreed upon in writing by both parties.
7. TERMINATION
7.1 Termination by Us We may terminate your access to an Offering immediately if you breach these Terms and have not remedied the breach within 14 days of written notice, or if other circumstances reasonably require it.
7.2 Termination by You You may terminate your access at any time by notifying us in writing. Outstanding fees for services already delivered remain payable and become immediately due upon termination.
7.3 Effect of Termination Upon termination, each party must promptly return any confidential information or materials belonging to the other party.
8. INTELLECTUAL PROPERTY
8.1 Our Materials All training decks, course content, worksheets, frameworks, videos, logos, brand assets, and related materials are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable licence to use these materials for the personal or internal business purpose for which they were purchased. You may not reproduce, redistribute, or repurpose our materials without our prior written consent.
8.2 Materials You Provide Any materials you provide to assist us in delivering services remain your property. You grant us a limited licence to use them solely for the purpose of delivering your Offering.
8.3 Developed Materials Where we create bespoke deliverables specifically for you as part of a service engagement (as agreed in writing), ownership of those deliverables vests in you upon full payment.
9. CONFIDENTIAL INFORMATION
Each party agrees not to disclose the other's confidential information except as necessary to deliver or receive the services, or as required by law. This obligation survives the end of the Offering.
10. YOUR SUBMISSIONS
By submitting comments, photos, testimonials, or other content via our platforms or communities, you grant us a non-exclusive, royalty-free licence to republish your submission (in whole or in part) for reasonable business purposes, unless you explicitly instruct us otherwise at the time of submission.
11. REVIEWS
We may invite you to leave a review of your experience. Reviews must be honest, based on genuine experience, free from offensive language, and compliant with applicable laws. We reserve the right to decline publication of reviews that do not meet these standards.
12. DISCLAIMERS
Our Offerings are provided for educational and advisory purposes. While we bring significant expertise and experience to every engagement, individual outcomes will vary. Nothing in our Offerings constitutes legal, financial, or medical advice. We are not liable for any indirect or consequential loss arising from your use of our services.
We make reasonable efforts to ensure the accuracy of our content but cannot guarantee that all information is complete, current, or error-free. You use our materials at your own risk.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, our total liability to you is limited to the fees paid by you for the relevant Offering. We are not liable for any indirect, incidental, or consequential loss or damage arising from your use of our services.
14. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claims, damages, or costs arising from your misuse of our Offerings or breach of these Terms.
15. DISPUTE RESOLUTION
If a dispute arises, both parties agree to first attempt resolution in good faith. If unresolved, we agree to attempt mediation before pursuing formal legal proceedings.
16. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the jurisdiction of the courts of New South Wales.
17. GENERAL
These Terms constitute the entire agreement between you and us in relation to your purchase and use of our Offerings. If any provision is found to be unenforceable, the remaining provisions continue in full force. These Terms may only be amended in writing.
